Legal Question in Bankruptcy in Wisconsin

NSF Checks and Bankruptcy

What is the law as it pertains to NSF checks and filing chapter 7? For example, a person write a check to a payday loan company and the check bounces. Is the customer protected by filing chapter 7, or do they still have to pay the check?

Re: NSF Checks and Bankruptcy

Hello,

You still have the debt to payday. That can be discharged. You tried to pay it with the check, but it didnt work because no funds were there to cover it. You may have penalities for NSF from the bank or payday, but I do not believe you have to pay the payday check. I do not have all the facts about your situation, so it is not possible to help you with any opinion you can rely on. An attorney should be able to give you a final answer if you provide more facts. Good luck, Mark J. Mahoney 920-984-4529
