Can we do with it as we please?

My boyfriends ex-girlfriend moved out in the middle of October 2006 and left a couch,an entertainment stand, and a TV behind. Since October she has said everyweek that she will pick it up and has NOT picked it up yet. Are we able to sell or get rid of her belongings since she has yet to get them?

I would suggest sending her a letter, by certified mail, giving her a reasonable deadline to pick up her stuff, and letting her know that if the stuff is not picked up by that date, that you will be selling it or getting rid of it. Keep copies of the letter sent, and see if you can confirm that she or someone signed for it. If you can confirm by letter or phone that she got the letter about the deadline, I think that you can probably get rid of it after that as long as you can show and prove that you made all reasonable attempts to let her know to pick it up or it would be disposed of or sold. Photograph or itemize what is sold or disposed of when you do it. If she should sue you or something, keep the proof of the letter, contact, photos, and itemization for evidence.
