Legal Question in Credit and Debt Law in Wisconsin

minimum payment

my late husband left 2 credits bills that were in his name only. If I cannot reach an agreement with the compaies what is the minimum amount required to pay each month to keep the law satisfued and the compaies from doing anything? The small estate left was used to purchase my present house.

Re: minimum payment

Normally if the credit cards were not in your name you have no liability and no responsibility. Your husband's estate might be responsible but normally the credit card companies would need to file a claim in probate court.

There is no minimum that will keep them from doing anything but I suggest you check with your probate attorney (or whoever handled the estate) to see if the companies can even make a claim.

Do check your credit reports to see if they have put these accounts on your credit report. http://www.alabamaconsumerlawblog.com/2007/03/first_critical_step_to_correct.html

Are they calling and harassing you? Sometimes they will claim that since you were married these are your debts. That is false. http://www.alabamaconsumerlawblog.com/2008/01/are_spouses_responsible_for_th_1.html

Feel free to email me if you have any more questions.

Best of luck,

John
