Legal Question in Criminal Law in Wisconsin

i haven't been charged yet but I'm going to be charged with a felony in the next 2 weeks, my attorney says we're going to ask for a deferred sentence. i have a trip to mexico already paid for in the next 2 weeks, will i still be able to take it?

If you already have an attorney, you need to ask him or her this question. Usually, a person who is not yet charged is not yet legally restricted regarding travel by any court orders since none can exist until the government has first involved a court by issuing a charge. However, the police and DA always have the right to arrest you without any court order, although they would need to bring you to a judge to set bond conditions within a reasonable period of time on a date when the courts are open for business. If they believe that you are uncooperative for any reason or cannot be trusted to appear on your own and stay out of further trouble, they are more likely to exercise the option to arrest you without any court order.
