Legal Question in Elder Law in Wisconsin

WI. Mom, brother and sister on life estate. Mom permanently resides in nursing home. Life estate language of upon death of mom or permanent nursing home residence transfer to brother and sister. Younger brother living in home, not on life estate. Can he be evicted?

If the brother you speak of is on the deed creating the life estate, he cannot normally be evicted.Whether or not he is in the "estate" is irrelevant. If he is not on the deed, however, it may be possible for your lawyer to evict him if there are other legal grounds for doing it, such breach of his lease, etc.
