Toxic dumping

Say a employee of mine made a decision to dump more waste than a permit allowed and my company got a lawsuit put on us. Is there a law or any protection the company can use to say it was the employees fault?

In general, that is not a good defense. As the employer in most cases you are responsible for the actions of your employees unless his intention was malicious. In sum, negligence of an employee is not a defense. I cannot comment any further since I don't know the facts of the case.
