Legal Question in Family Law in Wisconsin

how are assets divided

I have been in the process of a divorce for 17 months now. My husband has a variety of stocks, bonds and mutual funds in excess of 100,000. He says that I am not entitled to them because he had this money before we got married. Most of the stocks, bonds and mutual funds have my name on them. Am I entitled to half or only half of what he made after we got married? We have been married for 9 years now.

Re: how are assets divided

Greetings,

Here may be a typical case where hiring a lawyer could cost you a few thousand dollars, not hiring one, could cost you considerably more.

Property owned prior by your husband to your marriage MAY be his separate property, or it may not be. Even if some of it is, the growth in value during the marriage might be half yours. Finally, if the assets are now in your name, it will be difficult for him to argue that they are just his.

Speaking of difficult, it is not possible for me to advise you of what you may be entitled to here. There are too many possibilities that I cannot assess without having the detailed information about who owned what and when. You should get some legal help to get you what you deserve.

Best wishes, Attorney Mark J. Mahoney 920-984-4529
