Legal Question in Family Law in Wisconsin

how does one get a sentancing hearing?

I took my x-husband to court to make him comply with court orders to file back taxes..the court found him in contempt and gave him 90 days to comply. This was last year and he still hasn't done it. How do I request that he is sentanced and get him to comply? I paid 100% of back taxes so far and wish him to file and pay me my half as stated in the divorce decree.

Re: how does one get a sentancing hearing?

The court order that was generated from the contempt hearing should list conditions on how to have compliance. Perhaps the order states that an affidavit can be filed stating that your ex-husband has not complied with the terms and conditions and therefore jail time needs to be imposed pursuant to the court order. Again, the court order governs, as well as local court rules as to the applicable filings that need to be made to the Clerk of Courts office to have an enforcement hearing of a court order.

This is not legal advice. This is an answer to a general question without all the facts being present. Please contact me at (262) 642-4368 to discuss this further. Victoria A. Oleniczak
