Visitation of my son

My ex girlfriend has put a restraining order on me, I only can see my son when she contacts me, which is once every other month. I went to court yesterday to get visitation rights over my son, however it was only to establish paternity. Judge informed me to contact mother to see my son and to document anytime she refuses. She refused and called police to tell them I violated restraining order. Is there anyway other way I can see my son before next court date? There are no third parties involved.

You have several complex legal problems going on at

the same time. A family court visitation order does

not trump a retraining order. You must get permission

in writing from both courts. Also, the paternity

action is an opportunity for you to get a visitation order,

but this will not happen automatically. There is

a presumption of full legal custody to the mother in a

paternity action. You really need a lawyer in both matters.
