Yes, it is legal, and once you are married, assuming there are no issues with your foreign spouse applying for an immigration benefit, then you can petition for his/her "greencard". However, I would make sure you have an experienced immigration attorney review his/her case before you file, just to make sure there are no potential issues that you are unaware of.
