Re: 3-wheeler accident

A number of different rules may apply to your daughter's situation. If she was a minor at the time, in Wisconsin, she would have until she turns 18, plus the appropriate amount of time for the statute of limitations to run. The statute would be 3 years for negligence, but could be 2 years if the actions were intentional. A good personal injury attorney should be consulted to see exactly where your daughter's situation resides. Most such attorneys will meet initially for no fee.

Where the accident was is a critical factor. As is your daughter's age, and how the accident occurred. I'd be happy to speak with you about this. You may call me at 414-257-4100.

Re: 3-wheeler accident

Whether your daugher was an adult or a minor is the factor that will determine what the applicable statute of limitations would be in this case, assuming that the accident happened in Wisconsin. There is generally a three year statute of limitations FOR AN ADULT if the accident happened in Wisconsin. If it was in another state, then that state law would apply. If the accident happened in Wisconsin, and if your daughter was a minor at the time, the statute of limitations would generally be until her 20th birthday. If your daughter was disabled due to a mental illness at the time of her accident, the statute of limitations might be different. I can answer your question more accurately if you can provide me with more information, either by e-mail or by phone.
