Legal Question in Personal Injury in Wisconsin

RE: Personal Injury Accusation

Hi, I have a quick question. My question is can my fiance get sued for giving someone else a broken nose if that person did not go to the hospital the night of the incident?? How do we know that he didn't get into another fight or something else didn't happen to cause his nose to become broken?? Thanks so much.

Re: RE: Personal Injury Accusation

Yes, your fiance can get sued. The fact that the person did not go to the hospital right away may make proving the case more difficult for him, but, in the final analysis, a judge or jury would have to base its decision on whether the injured person proved his case, or not. If the judge or jury believes the testimony of the person who suffered the injury, then he will win the case. By the way, the injured person has three years from the date of injury to file a lawsuit.
