Suit over accident

I was in an accident auto on 10/05/2006. I have asked my attorney to settle my case and he keeps putting it off and not answering my calls.

Plaintiffs' lawyers are not always able to settle cases whenever they want to. Everything is dependent upon the insurance company that will have to pay the settlement. I handle many cases that go to trial without the insurance company ever having made any attempt to settle the case. Thus, the problem may be on the part of the insurance company. Your attorney does have an obligation to answer your calls and to keep you informed of what is happening with your claim. My suggestion would be to continue calling him, or write to him, in order to find out what is going on. If that fails, you may have the right to take your case to another lawyer, although your current lawyer might have a claim for fees if he has a written fee contract signed by you and if he could show that he was fired without good cause. Thus, my suggestion that you keep trying to get a response from him. Keep in mind that the statute of limitations for personal injury cases in Wisconsin is three years from the date of the accident. That is your deadline for filing a lawsuit against the other driver and that driver's insurance company.
