Land Contract (Strict Foreclosure)

In July I the vendor wanted to do a land contract of my house with a person. The terms of the land contract agreement was made up by the vendee not myself they are down payment, the vendee to have insurance,to make payments to me & to pay any deliquent taxes. He has been paying payments to my bank instead. The vendee & I got the paper work notarized & did a title transfer. No lawyers involed due to vendee said he knew what he was doing.Well it turns out he took me for a ride.He has not followered any of the terms agreeded upon. The contract is for a year.Is there any way to get him out before since he is not following any of the terms?I heard I would have to do a strict foreclosure and I can't wait around cause there are issues with the vendee. He took & will not give up personal property, vechiles that I left there cause we had a verbal agreement that it could stay until he got finacing. He is creating waste by remodeling cutting down trees leaveing piles in the yard & not keep it clean.A big issues he is venting a wood fireplace that was meant for LP out a chimmney with another gas LP stove running right by that is vented there to.I can't afford a laywer I wrote up a complaint do.I write up a summons to?Also he can't get finacing. HELP!

Re: Land Contract (Strict Foreclosure)

Greetings,

Unfortunately, real estate can be complicated and it is not possible to do much through the internet. Yes, a summons must be done along with the complaint and both are served upon the defendant by the sheriff or process server. It is difficult to do a lawsuit like a foreclosure without a lawyer. I am concerned about what you said about title. Usually you don't sign that over until the contract is over.

Best wishes,
