Legal Question in Real Estate Law in Wisconsin

Quiet Neighborhood vs Developer

I live in a small 40 home subdivision on the outskirts of a city of 50,000. The subdivision has no outlet and is surrounded by farmland which a developer purchased for building 300 low-medium expensive homes. The developer wants the local government to condemn a home (not mine) within the subdivision, to extend an existing road within the neighborhood through to the new subdivision. This additional traffic would destroy the quiet enjoyment of our neighborhood life that enticed existing homeowners to buy and build within the neighborhood. Will a petition to stop this do any good? What options are available to me?

Re: Quiet Neighborhood vs Developer

There are a number of options available to you.

Your question about going directly to the politicians

with a petition is usually very good, but probably

doesn't have any legal consequence other that

pressure on an elected or appointed official.

You could also hire an attorney who is well versed in

zoning law. Such an expert would get other experts

as witnesses to show your local zoning board how

such a road extension is not in the communities best

interest. This would give you a court route, in the

event a decision goes against you.

I am not a zoning attorney, but one of my partners is.

We generally are able to handle matters within 100 miles

or so of southeastern Wisconsin.

Good luck with your matter.
