Legal Question in Tax Law in Wisconsin

Commercial Tax Preparer's Mistake

Does a consumer have any legal protection or recourse when a commercial/paid tax preparer makes a mistake on a federal tax return that results in the taxpayer having to pay money back (a tax lien)? If there is legal protection, recourse, where do I find that info?

Re: Commercial Tax Preparer's Mistake

Usually the recourse is something the tax preparer would discuss with you prior to working on your tax return. You should first try to work it out with the tax preparer. However, if there was an existing tax lien, and you owed the money to the taxing authority, paying off the lien may have been the best thing for you to do. I can't imagine a tax preparer making an error that would create a tax lien. Apparently, the tax lien was already existing, and usually paying off a tax lien is a good thing and the right thing to do. Your tax preparer may have just been doing what he or she was legally obligated to do. There is probably no recourse for you if that was the situation.

Try to work this out with your tax preparer. If you owe the money, pay it back and look forward to future tax refunds if you are so entitled.

Good luck.
