Probate

If I die without a will does my estate automatically go to probate court.

Wisconsin has a number of simplified procedures,

enabling heirs to avoid probate in many circumstances.

The particular procedure will depend upon the type

of asset involved, the value of the asset, and the

relationship of the heir receiving the property. For

example, a residence may be transferred to a

surviving spouse simply by means of an affidavit,

whereas money going to an unrelated party would

require a significantly more formal proceeding to

transfer.

An experienced probate attorney would use the

method most suited the the assets in question.
