Legal Question in Workers Comp in Wisconsin

If I have a workers comp injury, and settled in one state, when I move to a different state, can I still recieve treatment for the injury?

You can certainly receive treatment in any state you wish. However, you may be required to pay for it yourself or may need to bill it to private insurance. Regulations vary from state to state as to whether workers compensation insurer must cover treatment which is out of state. In most states, insurers can also decline to pay if there any likelihood that the illness may have additional causes or aggravating factors aside from the work related injury, regardless of which state the medical care occurs in. These can include obesity, smoking, age, arthritis, alcohol or other substance abuse, stress, etc. Insurers can also decline to pay any bills which they believe to be excess and above the reasonable, necessary and customary local billing practices. Frequently, persons suffering a major workplace injury are therefore required to declare bankruptcy to eliminate any possible personal liability for past medical bills. Luckily, even if they must do this, workers? compensation disability awards can often be claimed as exempt in the bankruptcy and retained by the injured worker.
