Legal Question in Real Estate Law in Florida

I moved out of my apartment complex on 6/30/2012. It is now July 31, 2012 and I have not received my security deposit back. I have emailed several times and they keep saying they are sending it, but have not. About 5 days ago via email on yahoo, she stated she was going to be deducting 100 dollars from the deposit.

It is my understanding that if they are going to deduct money from the deposit, they need to notify my by certified mail. Which they have not done. What are my options as far as recovering my security deposit?

I would send a demand letter to your landlord, certified, return receipt, advising them that they are now responsible for refunding your entire security deposit. If the funds are not sent within a week to 10 days, then I would consider filing a small claims action, if less than $5000 is due. You should hire an attorney as there is a provision in the statute for attorney's fees to be assessed.
