My self sagar I am 26 year old My grandfather died in the year 2000 and he dint made any wile for his property and he got 3 sons and 2 daughters in that my mom is elder among all the children�s for first wife and he got 2nd marriage after first wife death and he got 2 daughters .in the year 2001 one of my mama asked my mother to give her share to him instead of property he will pay money so my mom agreed and signed of the agreement. But he dint gave money or property to my mom and in 2006 my mama transferred all is property to his 2 children�s name. now i want to know do i got the right to fight to get my mom share? can I put cheating case on my mama

Dear Sagar,

Since your grandfather passed away intestate (without a Will), his property vests in your grandmother and since he has remarried, his estate will be equally divided amongst all the legal heirs of both the wives i.e each being entitled to 1/7th share of his estate. Since your mother has already relinquished her 1/7th share in the name of your uncle, your uncle holds 2/7th share of the estate. You should insist upon your uncle paying up your mother's share in the estate to your mother. Yes, a case of cheating may be registered.
