1 Answer from Attorneys

1) The two-child norm is active in states like Andhra Pradesh, Gujarat, Maharashtra, Odisha.

2) In Rajasthan, persons with more than two child are stopped at the entry point of applying for government services. A proposal is also underway for relaxation in two-child norm in case of remarriage also.

3) The memorandum, brought out recently reads, The appointing authority shall also obtain an affidavit from the employee with reference to having only two children on or after 01.06.2002, prior to granting an ACP (Assured Career Progression). The employee having more than two children shall not be deemed to have been disqualified, so long as the number of children he/she has on 01.06.2002 does not increase.

4) The new order actually relaxes the clause of total disqualification of ACP for employees with more than two children after June 2002. But those with more than two children will have to wait five more years for ACP in comparison to those who have two or less children.
