Dear Sunil,

Section 66 in The Information Technology Act, 2000 reads :

66. Hacking with computer system.-

(1) Whoever with the intent to cause or knowing that he is likely to cause wrongful loss or damage to the public or any person, destroys or deletes or alters any information residing in a computer resource or diminishes its value or utility or affects it injuriously by any means, commits hacking.

(2) Whoever commits hacking shall be punished with imprisonment up to three years, or with fine which may extend up to two lakh rupees, or with both.

Section 420 of Indian Penal Code : "Cheating".

You remain accountable and liable for monitoring and tracking internet access and usage within your shop i.e everything done through your unique Internet Protocol (IP) address.

The onus lies on you to prove to the Police that it was another person who misused the internet connection providing your Bank A/c details for an on-line purchase transaction. You will need to provide the detail thereof to the Police in your reply to the FIR lodged against you.
