we are doing trading with a person but he is not proprietor of this firm another person is a proprietor of this firm.we sent legal notice to a person who is not proprietor and mentioned name a person true proprietor in notice as well as.can we file 138u/s to true proptietor.

Dear Sir / Madam,

Yes, you will have to file the same notice under Section 138 of the Negotiable Instruments Act, 1938 quoting the correct Proprietor's Name and other particulars.
