Legal Question in Criminal Law in Pakistan

Bank has filed recovery suit against me. My property is also mortgaged. They made out of court settlement and I issued cheques for installments. However, the aggreement was not presented in banking court. As per aggrement, bank will stop proceedings until recovery. But they started proceedings before that. Now they filed FIR under 489-F. What legal remedies do I have? Can I challenge FIR?

Yes FIR can be challenged and the Case will be filed in the Banking Court Only whereas there is no concept of Out-of-Court Settlement.

You should go for quashment of FIR under 561-A or challenge the whole case under Article 199.. For more [email protected]

best of the remedy ofcourse is to file petition for quashment of F.I.R before higcourt.however since that proceedings may take time you are in need of getting bail before arrest.for further querries may contact at [email protected] .chamber of abdul jabbar khan former District and session judge.
