in the company can any Director be involved directly without servicing the legal notice in case of return of the cheque ie 138, where service of notice is the base to initiate the lodging of complaint?

Before making a complaint u/s 138, it is mandatory to serve a demand notice.

Before filing a suit you need to give notice of for demand of payment within 30 days and after that you can file a suit within 60 days .
