Legal Question in Criminal Law in India

I got the refund of Rs. 7.0 lacs from a promoter by 4 post dated cheques as he could not complete and handover the flat to me due to some title deed litigation on the land. Out of 4 cheques, 1 cheque of Rs.1.0 lacs got cleared by the bank but balance 3 cheques of Rs. 2.0 lacs each got bounced due to insufficient fund. After lot of persuation, I have lodged an FIR at police station and filed a suit under law 138 for bounced cheques at Alipore Police Court, Kolkata for about 6 months back. The promoter did not attend the first two summons. Even more, he promised at Police station during end November'14 in front of me and my lawyer to return my money in installments within next 3 months, which has not yet happened. I have also informed the Commission of Police on the status and got a reply from him that the matter has been forwarded to Dy. Commissioner of Police of that area. Can you please suggest me next course of action to be taken by me to recover the money urgently.Thanks a lot in advance for your valuable advice. Regards,

your 138 case is pending in the court.that will help you. Further if you want you can file a civil suit under O37 which is a summary trial.
