Legal Question in Family Law in India

My brother who is above 30 years of age married to a girl in 2005. He was living with his wife separately. One day his wife left him after few years and he committed suicide who by luck got saved and was rushed to mental hospital, my aged parents who spent huge amount of money for saving his life.. Once he got saved he was living with us(family with parents, 3 sisters and one brother I.e. me) and was still on medication. After few months he started physically assaulting all of us. Before he committed suicide he once came here with his wife and he tried to kill our mother, and no one from the family filed case or register FIR against him as my father was worried about his image and everything. Coming back to the days after his suicide and started living with us he would harass us daily and beat us even for small fights for T.V. remote while watching T.V. and it continued forever in all aspects whether it be watching T.V., going out, eating, having shower, etc.

He used to daily fight with our father and continued his hooliganism.. Even the society members were getting mad because of his behaviour. But no one ever made courage to go to police station.

I tried several times but my family members would stop me from doing that.

This was going on for years, and is still going on.

But now I can't take it anymore and even because of this family issues I got depressed and started drinking alcohol and smoking weed. I even have doctors visit for medication of my depression.

Nowadays it has even been difficult to move our head in house as he is all around us. He keeps walking in the house whole day, keeps eye on what we are eating and start fighting. Today I did fight back and was physically hurt (even before but today I made courage to make a post over here).

Now I have came to conclusion whether he stays in the house or me.

Is there any way for me to take actions legally and even file a complaint against my parents for keeping this mentally ill psychic married man in the house.

1 Answer from Attorneys

First of all file a complaint against him, when he assault your physically.

Then also mentioned that he tried to commit suicide, as committing suicide is also an offence.

Further also mention everything happened in past about his attack on mother and other family members.

Then police will record statement of your family and your neighbors and society members and arrest him.

Then stop your parents to get his bail.

Good luck.
