Legal Question in Family Law in India

Dear Sirs,

My wife is applied for divorce and counseling is going on. Three counseling is over and the next one is 12th July. She is seeking the mutual consent divorce. But, my lawyer is advising me to convince me to pay the lump sum is about 4 to 5 Lakhs for my 3 years daughter. I have slightly doubt on my lawyer she is not favor to me. I am helpless and I am getting 20 thousand per month as a salary and working in Pvt Ltd. Hence the job is not stable.

She is left with me alone once she got conceived.

After that I was tried to call her to run the smooth life she is not responded.

I am not touch with her for the last two years exactly.

She is not ready to share the ups and downs and pain.

But she is enjoy the life luxuriously.

Please advise me to come out from the Divorce case with no financial impact to me.

1) Present to the court the financial status of both.

2) The court will decide the monthly maintenance. If u wish u can go for one time payment.

3) U cannot avoid financial burden unless she agrees.

If your wife is seeking mutual consent divorce, it will require you both to agree for a divorce. If while discussing consent terms, she voluntarily gives up her right to maintenance, then you dont have to pay her anything now.
