Legal Question in Family Law in India

If a friend of mine who got married under SMA 1954, it's been about a year and his wife is pregnant. He has got a nice opportunity to study abroad in IRan . He is ready to take care of his wife by paying her from his sources of income.Now if the wife is not ready to come along with him despite the fact he is ready to provide her with the best he could. What can the husband do now? Can he file RCR 125? He is not ready to leave her?

Dear client,

Do not mix legal with family life. RCR is only is only a directive to make remember the bounden duties to another partner in married life, the partner is not bound to obey this direction of the court. At first convince the matter with the family members in both families and find out the actual reason and you can solve this problem.Do not think the word legal in family matters strictly. First try to convince through family if not ready only then file section 9 HMA restitution of conjugal rights.
