Legal Question in Family Law in India

Hi. I'am 34 year Indian male sales professional.

I'm Science graduate and earns approx 75000 per month. I have daughter with age of 5.10 years and newly born 1 month old son.

I want custody of my daughter without filing for divorce.

My wife along with daughter and newborn baby is at her parents since last 3 months. My wife is pharmacy graduate and is housewife. I am 5.5 year younger to my wife & we have been married since last 6.9 years now. There seems to be no progress happening in near future to sort out conflicts.
