hello i m a married women my age is 30 and i m married from last 5 years.i have got 4 years old daughter .my problem is that my husband want to give me divorce and i dont to break the relation i have convienced him many times to stop him but he is not listening to me .what if he will give me a divorced how much amount he will pay for her daughter monthly.or he will pay for me also or not . is there any solution to stop him cam i stop him to give me a divorce plz help me i m from pakistan .tell me what islamic law says about this how much he will send to his child ?

Salam,

Madam you can not stop him from giving you divorce. You can try to put relatives in it to force him to not to give talaq. In Islamic law the principle is simple "Al talaqu Maratan" is used in Quran. It means divorce is 2 times and after that either the husband has to leave or reconcile with the wife. There is difference of opinion of Islamic schools of thoughts over the pronouncement and methods of talaq. However our law accepts the Shafi point of view in talaq. You will get the custody of your daughter. In our law, custody of children under 7 goes to mother and above that goes to father. But in case of girl the custody of girl remains with the mother till she gets married. Also the husband is liable to pay maintainance for the daughter till she gets married. The amount of maintainance is dependent on the income of father.

You are entitled for maintainance, your belongings, gold ornaments and dowry articles that belong to you, haq mehr(dower amount) and maintainance till the day you remain his wife.
