Legal Question in Family Law in India

I am NRI woman living in Australia with my 2 young kids below the age of 10 yrs.

My sister in law has filed false 498a case against my entire family including me even i never stayed for a single day with her she has put all false dowry allegations.

Is it wise for me to go to India alone and apply for AB and return back or its a risk after reaching India if the bail is denied or i am not permitted to travel abroad then i will be separated from my kids.

In my opinion, you should wait and watch if the investigating officer even wants to investigate into allegations against you knowing that you are abroad and there was no occasion for you to demand any dowry etc.. Investigation Officer, may send you a notice under section 160 Cr P C in your name at your local address or address in australia. At that stage alone you should consider applying for AB. You stand a good chance to get AB, When was the marriage? How many times have you visited India after the date of marriage of your brother? Where did the marriage take place?
