Sir/Madam,
My wife filed petition on 28.11.2013 in lower court for monthly maintenance u/s 125. She requires Rs.15,000/- per month as maintenance. In her petition she mentioned the I am a Railway Contractor & my monthly income is more than Rs.1 lakh. Actually I was working under a contractor as a daily basis labour & getting salary Rs.3,000/- per month. I am a heart patient & suffering from various disease. For her harassment , mental problem & long aliment I have lost my Pvt. job also now I am unemployed no income source & on the other hand my mother is suffering from bone disease problem due to her back bone band she cannot move & father is suffering from High BP. In this situation it will be not possible for me to pay maintenance if any such type of order pass. And it seems to me that order may be pass within 2 or 3 moths. If so, in this condition what�s shall I do, Can I appeal in High Court for stop payment? What�s the procedure to close payment? She is greedy she wants only money. She wants to ruin my entire life. I am in great trouble. Please show me the way. Our financial condition is too bad & it is not possible to bear the case also. Please say how can I escape from maintenance u/s 125 ?

Clearly tell the court about your job and earning and also that you can't pay her any money.
