Legal Question in Family Law in Pakistan

Salam sir my question is me n my husband dont live together as he used to beat me we have no divorce just living separate. My two year old son is with me i m a doctor. I want to go to united states of america for my further education and job with my child. Me n my son have valid visit usa visa. Can my husband create a legal issue for me and specially my child? In that case is it neccessary to have khula or divorce to take my child's custody? Cant i just escape all this situation?

dear sister just get guardian certificate from civil court and then permission for taking out of country. its just two steps . not difficult .
