Legal Question in Family Law in India

My wife leave me & daughter 6 & 7 yrs. respectevly, 2 FIR in 2009 & 2010 against me are closed in court. And we living separately since 18/8/2010, my daughter(13 yrs. Now) living with me. Now whats my rights to file divorce or punish for neglect her own daughter.

1) What are earlier cases filed and court orders for keeping child in ur custody?
