Legal Question in Family Law in Pakistan

my ex wife got marriage in Canada. and I give monthly expense to my 2 daughters, now ex wife wants to go Canada with my 2 kids. she demands for guardianship. Can she file a suit against me for guardianship and is there any law to force me give guardianship.. ?

Yes, she can file case for guardianship. However, please note, in absence of any court order, minor children cannot leave Pakistan without father's permission. You need to contest the guardianship case, if it is filed. Or you can beforehand move to the court and obtain a stay order preventing your wife to take away your daughters.

Daughters remain with mother until they reach age of puberty. However, a mother loses her right of custody when she contracts second marriage.. If she files that case, she will give you a chance to get custody. She won't file a case rather she will take the girls with her secretly and u wont be able to find them rest of your life..
