Dear Sir / Madam,
The tenancy will lie in the name of your father with the Landlord's consent to the transfer if your mother has passed away intestate (without making a Will) without nominating the title owner of the tenancy rights. If she has left behind a Will clearly stating the family member's name(s) who will be the successors of the tenancy right, the Will will prevail.
