Legal Question in Real Estate Law in India
I am from Mumbai_Thane(Virar).
Our building is neary 7 year old. Due to crack on external wall and water sepage, a major portions of my flat is geting damaged, and this is more in the mansoon season. Also water flow through the stair case is giving a life threat to the members. I have written 2-3 letters to the managing committee, but everything went in vain. Committe is not considered it as a major problem.
In this condition, can I stop giving maintenance? Do I have a right to hold the mainteneance??. If not what is competent authority, to whom I can explain my problem for a better solution.
Your advise in this regard will be highly appreaciated, and it will be great help to me.

Dear Chandrasekharan,
If the Managing Committee fails to head to your request for repairs, you next line of action is to lodge a written complain to the Office of the Dy. Registrar of Co-operative Societies in Thane, to intervene and resolve all pending issues. Since withholding monthly maintenance involves penal interest @ 21% per annum, it is not recommended.
