Legal Question in Real Estate Law in India

A person having 2 wife. He have 5 children, from first wife he have 2 son and from second wife he have 3 son . He was die in the year 1981. The person having self acquired agriculture property in uttarakhand. After his death the family settlement had done between the 5 son equally but now the son's from second wife file a suit regarding the partition in agriculture land that partition was done between 2 widow in this first widow was already die. please give some suggestion in the respect of son . {according to upzalr act1 950]

1) During the subsistence of the first marriage, second marriage is void.

2) If after the death of first wife, he second wife claimed is valid.

3) All five sons will get equal share as per family settlement is correct.
