Legal Question in Real Estate Law in India

We have two separate agriculture land of same proportion.

My father is two brother.

On one land we have been cultivating for the last 20 years and after 20 year he (My uncle) has cultivated in our land without intimation to us in the midnight.

Is this fair?

Can opposite party do such thing without intimation to us.
