Legal Question in Credit and Debt Law in Alabama

Credit card lien on home with three owners listed

My mother-in-law has two credit card debts. One for 8,000, the other 10,000. Her home has no Mortgage, is free of debt, but there are THREE owners listed. My mother-in-law, my husband (her Son) and her daughter. All three owners are listed, but the Mother-in-law is listed as the primary. One of the credit card companies placed a lien on her house. Can the credit card company force her to sell her home to pay this debt even though she is not the sole owner of the home? Your help would be most appreciated.

Re: Credit card lien on home with three owners listed

Provided that the credit card company that placed a lien on her house has a valid judgmement and lien, they do have the right to execute on the judgment. After a certain time period, the creditor can attempt to "foreclose on the home" to collect on the debt. Of course the other owners have certain rights in the event this happens.
