Legal Question in Credit and Debt Law in Alabama

Forgery -Second Mortgage

Divorced man agreeded to continue to pay mortgage payment for the house left to the ex-wife. Exwife, she took second mortgage on house, forged his name to the documents ( bank excepted) notary copies somehow. Now, exwife let the house foreclose, and the debt is showing on divorced man's credit report. He did have a lawyer file a suit, but due to inaction on lawyers part. Suit was dropped. He still is paying her allomony. Can a court allow him to deduct payments from her check, to repay the second mortgage. So he can get the debt off his credit report. Is there a statue of limitations for prosicuting her for forgery?

Re: Forgery -Second Mortgage

I don't know about prosecuting but if it is on his credit report there may be some options. Why and when was the suit dropped? Was it dismissed with "prejudice"?

Contact me if you would like to discuss as there MAY be some options on this as it is essentially identity theft.
