Legal Question in Criminal Law in Alabama

Criminal Trespassing

Do I have a case of criminal trespassing against someone who is threatening me (on my land) but the person who rents the house says that they can be there? This is an elderly person whom is also harmed by this person but will not agree to file charges because it is a relative.

Re: Criminal Trespassing

a possible crime has occurred when someone threatens another person with the intent to carry out the threat, and the person threatened reasonably fears for his safety. the tresspass crime would probably be with your lessee since he has the right to sole possession of the premises under the lease. check with your local magistrate as to what criminal activity might have taken place.
