If we are separted and have been separted since Feb 06 with the intent to divorce and we have a child but her life style has become an issue, can I keep the baby in my care, with the assumption that I intent to seek full custody and allow her only visitation or do I have to sit back and let her tell me when I can or can not see my child. We had papers drawn up stating that we both wanted joint custody, but the attorney never filed the papers and is not in jail on drug charges. Everything has been goin find between the 2 of us until today when she has decided that I can only see my son 2 day a week. And as I stated her life style will become a very big issue.

Sounds to me like you need to proceed with the divorce action yourself and file a petition for temporary custody basing allegations in your petition on her life style. The old story, he who strikes first has a better chance of winning. Contact me if I can help.
