My husband was not the father

My exhusband and I had been separated for three years with separate addresses. I became pregnant during the separation by another man. Now I want to take that man to court for child support. My exhusband and I divorced legally after the baby was born. Does the father of my child have a legal right to deny paternity and not pay child support or once paternity is proven will he be legally responsible for child support? His name does not appear on the birth certificate, yet he has made three verbally aggreed upon child support payments.

Once paternity is established by the courts, he has an absolute duty to pay child support. You need to hire an attorney to walk you through the process.
