Legal Question in Immigration Law in Alabama

What forms and fees are required?

I am engaged to a U.K. citizen who currently has permanent resident status in Canada. If we were to marry while he is visiting, would he be required to leave the U.S. and return to the U.K. and then re-enter the U.S. and would he be considered here illegally unless he does that? Also, once we are married, what forms and fees will we be required to file in order for him to remain here and be able to work?

Re: What forms and fees are required?

It depends on what type of visa or on what basis he is visiting the US. If he is here from the UK on the visa waiver program then yes, he will have to return home to process his case. The second factor that comes in is how long has he been here and how long his authorized stay is.

There are numerous forms and procedures to go through when filing for your spouse to get a green card. It is something that would best be left to an immigration attorney. Feel free to call our office if you have additional questions or would like to schedule a consultation.
