Legal Question in Insurance Law in Alabama

Judgement

I reside in Houston, TX. I moved here from Florida, approx 2 years ago after 9-11 and before that I was a resident of Huntsville, AL & B'ham, AL from 1990 until 2001.

I just found out when trying to renew my license that I am not eligible for a TX driver license due to a traffice accident I had in Alabama in 1991 in the District Court of Madison County case # DV 1991-2638. The attorneys representing State Farm Mutual Automobile Insurance Company vs. me:--name removed--Carrie--name removed--says that my payoff on judgement dated May 29, 1992 is $6,229.06 and it has had a $0.70 a day since 1992. What I don't understand is how I have been renewing my license in AL and then had a FL driver license for 8 yrs, and now I am not eligible due to this. It doesn't seem fair, or right that I have been charged for something I had no idea about.

I am hoping that someone with your agency can advise me on this matter.

First of all this is not a free legal help agency. All the responses here are from lawyers who try to help out in a limited manner to see if people want to get a lawyer or some other choice. what probably happened in your case is that you were sued for this "debt" and perhaps not served properly. You're supposed to receive the lawsuit in your hand if they can find you. If not it can be published in the paper or some other place you can be found. If this was not done correctly, you can appeal the judgment in the trial court. Often service of the lawsuit is defective. Thing is, it will probably cost you $2000-$3000 or more to appeal it. Maybe you can make a payment plan. Actually, it would be interesting to see how they claim you were served. Might be a class action waiting to happen. Good Luck.
