Time frame for reimbursement in an auto accident

I was in a car accident in Nov 08 (not my fault) and the insurance company of the driver at fault has still not reimbursed me for my out of pocket expenses, nor have they given any indication as to whether they will or not so I can go ahead and file suit against the driver at fault. It is now the end of March 09. Is there a timeframe that the insurance companies either have to pay within or notify me of their intent? The accident happened in Alabama.

There is no time frame, and if they can hold you off for two years, you will lose your claim. Nothing prevents you from filing suit without their approval. They do not have to do anything for you until a judge or jury tells them to. They may still be investing the case. They may have a coverage issue with their own insured. Did you have uninsured/underinsured motorist coverage on your policy? You should put them on notice immediately if you have not already. Another thing you can do is write the person at fault for compensation. Once you write them, they may put pressure on their own insurance company to pay you.
