Legal Question in Military Law in Alabama

Getting out

My son is in the military and wants out. He would like an honorable discharge if at all possible. He is finding that what he was expecting to gain from his experience and what was offered to him is not so,fincancially. Our family is having money problems and he wants to be able to help. He can do so much better if he is at home. Any help or suggestions?

Re: Getting out of Military Service

This question cannot be answered on the info which

is supplied above.

The branch of service, duration of active duty

to date, medical, physical and educational facts

must first be ascertained.

If, as the posting speaks, the enlistment was as the result of Recruiter fraud ( highly UNLIKELY)

then there is redress in the Federal Courts. Other than that, civilian judges do not overrule the military, 99% of the time, nor do they like to be asked to look over its shoulder.

If and only if, the military sees that your son was erroneously enlisted, that is his best chance to leave service with a clean discharge; that is to say, either and Honorable, or a General under Honorable Conditions, or an Entry Level uncharacterized discharge.

That depends on so many factors that only a face to face meeting with him, by a civilian military lawyer, will give a real idea as to the scope of the problem and the most likely outcome.

We do these cases all the time. No two have ever been remotely alike.
