Dog bite liability

The following incident happended in my neighbor's

yard and the dog never left the yard. Here's what

happened - I saw my neighbors dog attacking my cat.

This dog is a pit bull and I could tell that my cat needed

immediated help. I entered the neighbors yard yelling

for the owner and attempting to rescue my cat. The

owner arrived but was unable to take control of the dog.

I continued to struggle with the dog until I could get my

cat to safety. The cat was rushed to the vet, but did not

survive. I suffered a deep punture wound to my left

thumb and several other abraisions caused by the dog.

In addition I have scratches and bites from my cat. Do I

have any right to sue this person for my damages and

for the loss of my pet? I realize this happened on her

property and that the dog was confined, but I feel she

was negligent in her ability to control such a dangerous

animal.

You may have a claim, but you would have to be able to show that the dog's owner knew or should have known that the dog had a propensity for attacking other animals or people, i.e.: the dog had previously attacked another animal or person.
